This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Guidelines for Intermediaries and Digital Media Ethics Code) Rules, 2021 that require publishing the rules and regulations, privacy policy and terms of use for access or usage of the website www.houseoftrevi.com by any person.

Trevi Furniture Corp Private Limited, having its registered office at [Plot No.167, Survey No. 130,131&240, KIADB Industrial Area Bommasandra-Jigani Link Road, Rajapura Village, Anekal Taluk, Bangalore – 560105] (“Trevi”, “We”, “Us” or “Our”), manages and operates the website www.houseoftrevi.com (“Website”), through which it inter alia facilitates the discovery, identification and sale of Trevi’s products and services (“Services”) to the users of the Website (“User”, “You”, or “Your”).

Trevi and the User/s may hereinafter individually be referred to as a “Party” and collectively as the “Parties”.

4. We recognise the importance of Your privacy and are committed to protecting it. This privacy policy (“Privacy Policy”), together with the Terms of Use available at Our Website ([https://houseoftrevi.com/pages/privacy-policy]), governs Your use of Our Website and outlines how We process, collect, use, store, disclose, transfer and protect the information provided to Us by You. This Privacy Policy is an integral part of the Terms of Use available on the Website, the terms of which are deemed to be incorporated by reference in this Policy.

8. Payment Information

a. A third party payment gateway provider may be required to collect certain Sensitive Personal Information from You, including, but not limited to, Your credit/debit card number or Your bank account details (collectively referred to as “Payment Information”).

b. All Payment Information collected from the You by such third party payment gateway providers will be used for billing and payment processes. The verification of the Payment Information shall be accomplished only by You through a process of authentication in which We have no role to play and hence, We shall bear no liability in relation to the same. We shall neither be liable nor responsible for any actions or inactions of third party payment gateway providers or any breach of conditions, representations and warranties given by them.

c. While We take all steps reasonably necessary to ensure that Your information including Personal Information and Sensitive Personal Information is duly protected by undertaking the security measures prescribed under applicable laws, You are strongly advised to exercise reasonable discretion while providing Us with Your information.

The information collected from You may also be disclosed to transferred to an acquirer, successor, or assignee as part of any merger, acquisition, debt financing, sale of assets, or similar transaction, or in the event of any insolvency, bankruptcy, or receivership in which information is transferred to one or more third parties as part of business assets.

1.The information that is collected from You may be transferred to, stored and processed at a destination within and/or outside India, for the purpose of disclosure of information in the manner provided in this Privacy Policy.

12. SECURITY OF INFORMATION

1. We take the security of Your information very seriously. The information provided by You shall be collected, used and shared by Us in accordance with the Information Technology Act 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 and other applicable laws.

2. We have put in place appropriate methods and managerial procedures to safeguard and secure the information obtained from You, and maintain the security of Your information as per the International Standard IS/ISO/IEC 27001 on “Information Technology -  Security Techniques - Information Security Management System – Requirements”. We only process Personal Information in a way that is compatible with and relevant for the purpose for which it was collected or authorized by You. The Website also enables Users to access their Personal Information and allows them to correct, amend or delete inaccurate information.

3. We use reasonable precautions to preserve the integrity and security of Your information against loss, theft, unauthorized access, disclosure, reproduction, use or amendment.

13. MINOR’S PRIVACY

In case We discover that a child under 18 (eighteen) years of age has provided Us with information (including Personal Information and Sensitive Personal Information), We will take all steps reasonably necessary to delete such data from Our servers. Parents or guardians who believe that We may have collected information from an individual younger than 18 (eighteen) years of age can submit a request at support@trevifurniture.com for such information to be removed.

1. Upon initial communication from Us, You may opt-out of receiving further communications. To be completely removed from Our mailing list, You may contact us in the manner provided under Clause 20.

1. The Website may contain links to other sites. If You click on a third-party link, You will be directed to that site. Please note that these external sites are not operated by Us and are not under the control of the Website.

2. If You choose to access any of the third-party sites linked to Website, You do this entirely at Your own risk and We encourage You to read the privacy policies of such websites before providing them with Your information. We have no control over, and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.

16. CHANGES TO OUR PRIVACY POLICY

1. We reserve the right to update, amend or modify this Privacy Policy from time to time to reflect changes in Our business practices or in the legal requirements, with or without notice. Any changes will be posted on Our website and will be effective immediately upon posting.

2. Please revisit this page periodically to stay aware of any changes to this Privacy Policy, which may be made from time to time. By accessing or using the Website, therein, the User confirms its acceptance to the Privacy Policy, as amended. Provided that if there is any change in the law for the time being in force, this Privacy Policy shall stand amended to that effect and both the Parties shall comply with the law as amended.

17. GOVERNING LAW AND JURISDICTION

1. This Privacy Policy will be governed by and construed in accordance with the laws of India.

2. Subject to Clause 17 below, the courts in Bengaluru, India shall have exclusive jurisdiction over any disputes that may arise out of or in connection with this Privacy Policy. 

18. DISPUTE RESOLUTION

1. In case of any dispute arising out of or in connection with this Privacy Policy, including a dispute regarding its existence, validity, interpretation, performance, termination, construction and enforcement thereof (“Dispute”), the Parties shall first engage in a good faith negotiation to resolve the Dispute.

2. If the Dispute is not settled within 30 days from the date on which the Dispute arose, it shall be referred for private mediation, on such terms as may be mutually agreed upon by the Parties, before a mediator that is agreeable to both the Parties. The venue and seat of the mediation shall be Bangalore, India and the language of the mediation shall be English.

3. In the event the Parties are unable to resolve such Dispute within 7 days of commencement of the mediation, which time limit may be extendable by mutual agreement of the Parties, the Parties shall be referred to and finally resolved by arbitration in accordance with the Arbitration Rules of the Mumbai Centre for International Arbitration (“MCIA Rules”), which rules are deemed to be incorporated by reference in this Clause. The seat and venue of arbitration shall be Bangalore, India. The arbitration tribunal shall consist of a sole arbitrator. The language of the arbitration shall be English.

4. The award of the arbitrator shall be final and binding on the Parties. The arbitrator shall be entitled to award costs of the arbitration. Subject to the aforesaid, each Party to any arbitration shall bear its own expense in relation thereto, including but not limited to such Party’s attorneys’ fees and the expenses and fees of the arbitrator shall be borne equally by the parties to the dispute.

19. SEVERABILITY

1.If any provision of this Privacy Policy is held by a court of competent jurisdiction or arbitral tribunal to be unenforceable under applicable law, then such provision will be excluded from the Policy and the remainder of this Policy will be interpreted as if such provision were so excluded and will be enforceable in accordance with its terms; provided however that, in such event, this Privacy Policy will be interpreted so as to give effect, to the greatest extent consistent with and permitted by applicable law, to the meaning and intention of the excluded provision as determined by such court of competent jurisdiction or arbitral tribunal.
